Terms of Service

These Terms of Service (hereinafter referred to as the "Terms") set forth the conditions for using the mobile application "Oshi Time" (hereinafter referred to as the "App"). Please read these Terms carefully before using the App. By using the App, you agree to be bound by these Terms.

Article 1 (Application)

These Terms apply to all users (hereinafter referred to as "Users") of the App and govern all relationships regarding the use of the App. Users shall comply with these Terms in good faith.

Article 2 (Use by Minors)

Users who are minors must obtain consent from a legal representative (such as a parent or guardian) before using the App. If a minor uses the App without consent and continues to use it after reaching the age of majority, such use shall be deemed as ratification of the acts performed while they were a minor.

Article 3 (Usage of Content)

All intellectual property rights related to the content provided in the App (including but not limited to text, images, and designs) belong to the developer or third parties with legitimate rights. Users may not reproduce, modify, distribute, or commercially use these contents beyond the scope intended by the App.

Article 4 (Premium Service)

  1. The developer provides "Premium Services," which offer certain functions and benefits for a fee.
  2. Premium Services are available as monthly or annual subscription plans.
  3. Fees, payment methods, and service details are presented on the purchase screen within the App.
  4. Contracts for Premium Services are established when the user completes the purchase procedure specified by each app store. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
  5. Paid fees are non-refundable for any reason, except where required by law. No pro-rated refunds are provided for cancellations made during the contract period.
  6. Developer may change the content or conditions (including fees) of the Premium Services at its discretion. In such cases, notice will be provided in advance.
  7. [About Free Trials]
    The developer may offer a free trial period for certain Premium Service plans. If the subscription is not canceled during the free trial period, it will automatically convert to a paid plan upon the expiration of the free period, and charges will be incurred. Please note that this may not apply to users who have previously utilized a free trial.

Article 5 (Advertisements)

The App may display advertisements from the developer or third parties. Advertisements may be managed by third-party providers such as Google AdMob.

Article 6 (Access Analysis)

The developer may use third-party access analysis tools to improve the service. This may involve collecting anonymous traffic data that does not identify individuals.

Article 7 (Prohibited Acts)

Users must not engage in the following acts:

Article 8 (Restriction of Use and Cancellation of Registration)

The developer reserves the right to restrict the User's use of the App or cancel the User's registration without prior notice if the User falls under any of the following:

The developer shall not be liable for any damages incurred by the User due to actions taken by the developer under this Article.

Article 9 (Suspension of Service, etc.)

The developer may suspend or discontinue the App, in whole or in part, without prior notice to Users if deemed necessary due to maintenance, force majeure (such as natural disasters), or other reasons. The developer shall not be liable for any damages incurred by Users or third parties due to such suspension or discontinuation.

Article 10 (Modification and Termination of Service)

The developer may change, add to, or terminate the contents of the App without notice to Users. The developer shall not be liable for any damages incurred by Users as a result of such actions.

Article 11 (Disclaimer of Warranties and Limitation of Liability)

The developer shall not be liable for any damages incurred by the User in connection with the App. However, if the contract between the developer and the User falls under the Consumer Contract Act of Japan, this disclaimer may be limited.

Even in the case provided in the proviso above, the developer shall not be liable for any special damages (including cases where the developer or User foresaw or could have foreseen the occurrence of damages) arising from default or tort due to the developer's negligence (excluding gross negligence). Furthermore, compensation for damages arising from default or tort due to the developer's negligence (excluding gross negligence) shall be limited to the amount of the usage fee received from the User in the month the damage occurred.

Article 12 (Handling of Personal Information)

Personal information obtained by the developer through the use of the App shall be handled appropriately in accordance with the separate "Privacy Policy".

Article 13 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.
  2. Any disputes arising in connection with the App shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the location of the developer's principal place of business.

Article 14 (Changes to Terms)

The developer may modify these Terms at any time without notice to Users if deemed necessary. The modified Terms shall take effect upon being posted within the App. Users who use the App after the modification shall be deemed to have agreed to the modified Terms.
